Terms of Service for ZunoTales

Welcome to ZunoTales! These Terms of Service ("Terms") govern your use of our web application and services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

PLEASE READ THESE TERMS CAREFULLY. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICE.

1. Account Registration and User Roles

To use ZunoTales, you must be at least 18 years old or the age of majority in your jurisdiction. When you register, you must identify your role as either a "Parent" or an "Educator."

  • Parents/Guardians: You may create profiles for children for whom you are the legal parent or guardian. By creating a child profile, you consent to our Privacy Policy on behalf of that child.
  • Educators: You represent and warrant that you have obtained all necessary consents from your educational institution and/or the students' parents/guardians to create profiles and use the Service in compliance with applicable laws (such as FERPA in the United States).

You are responsible for all activities that occur under your account.

2. Use of the Service

You may use the Service to generate stories, illustrations, analytics, and other content for personal, non-commercial, or educational purposes. You agree to comply with all applicable laws in your use of the Service.

3. User Content and Generated Content

In short: You own the ideas you submit, but you give us permission to use them to create stories and improve our service. We own the final stories and illustrations generated by our AI.

  • Your Content: You retain ownership of the original ideas, prompts, and text you provide to the Service ("Your Content"). You are responsible for Your Content and affirm that it does not violate any laws or third-party rights.
  • License to Us: By providing Your Content, you grant ZunoTales a worldwide, perpetual, royalty-free license to use, process, reproduce, and create derivative works from it for the purposes of providing, maintaining, and improving the Service. This includes using anonymized content to train our AI models.
  • AI-Generated Content: The stories, images, analytics, and narrations generated by the Service ("Generated Content") are owned by ZunoTales and its licensors.
  • License to You: We grant you a worldwide, non-exclusive, royalty-free license to use, reproduce, and display the Generated Content for your personal, educational, and non-commercial use.

4. Acceptable Use and Content Moderation

In short: Be respectful and don't create harmful content. We can remove any content that violates our rules.

You agree not to use the Service to create content that is illegal, harmful, harassing, defamatory, obscene, infringing on intellectual property, or that violates the privacy of others. You may not provide personally identifiable information about any child for whom you are not a legal parent, guardian, or authorized educator with proper consent.

We reserve the right, at our sole discretion, to review and remove any of Your Content or Generated Content that violates these Terms, without prior notice.

5. Copyright Infringement (DMCA Policy)

In short: If you believe someone has posted your copyrighted work on our platform, follow these steps to let us know, and we will take it down.

ZunoTales respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances, users who are deemed to be a repeat infringers.

If you are a copyright owner and believe that any content on our Service infringes upon your copyrights, you may submit a notification by providing our Copyright Agent with the following information in writing:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material that is claimed to be infringing and where it is located on the Service.
  • Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

6. Subscriptions and Payments (Future Feature)

While many features of ZunoTales may be free, we may offer premium subscription plans in the future. Should we introduce such plans, the terms of payment, subscription length, and features included will be specified at the time of purchase and will become part of these Terms.

7. Your Data Rights and Privacy

In short: Your privacy is important. Our Privacy Policy has all the details. You can manage and delete your data from your account settings.

Your privacy is critically important to us. Our Privacy Policy details how we collect, use, and protect your data, and is incorporated by reference into these Terms. We recognize your Right to Access and your Right to Erasure (the "Right to be Forgotten"). You can manage your profile information and delete your account directly from your account Settings page.

8. Disclaimers and Limitation of Liability

In short: We do our best to provide a great service, but we can't guarantee it will be perfect. We are not liable for any damages that may arise from your use of it.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. ZunoTales makes no warranties regarding the accuracy or reliability of the Generated Content. AI-generated content can contain inaccuracies. You use the Service at your own risk.

IN NO EVENT SHALL ZunoTales BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

9. Termination

We may terminate or suspend your account at our discretion, without prior notice, for any reason, including a breach of these Terms. Upon termination, your right to use the Service will cease.

10. Governing Law

These Terms shall be governed by the laws of Portugal, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Cascais, Portugal.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes, for example, by sending you an email or displaying a prominent notice within the Service. By continuing to use the Service after revisions become effective, you agree to be bound by the revised terms.
