Terms of Service

1. Acceptance of Terms

By creating an account and using our Services, you affirm that you have read, understood, and agree to these Terms and our Privacy Policy. These Services are provided by Galactic Matrix - Portugal. You also affirm that you are at least 18 years of age and are the parent or legal guardian of any child whose information you provide, or you are an educator with the proper authority to act on behalf of your students.

If you do not agree to these Terms, you may not use the Services.

2. The Services

ZunoTales is a story-based learning platform for children aged 3 to 12. Depending on your plan, the Services allow you and your child to create illustrated stories, listen to audio narration, translate stories into other languages, follow curriculum-aligned learning adventures, generate rhymes, take comprehension quizzes, and write original stories in Young Author Mode. For children, we require a parent, legal guardian, or authorized educator to create and manage the account and all child profiles.

We are continually developing the Services. We may add, change, or withdraw features, and availability of any particular feature may vary by plan, platform, language, and region.

3. How Stories Are Made

Our stories are generated by AI, with safety checks — and a grown-up still matters.

Story text, illustrations, and narration are produced using artificial intelligence. You should understand the following before relying on any output:

  • Third-party models. We do not train our own AI models. We direct third-party foundation models — currently provided by Google — using our own instructions, story structure, and safety and quality checks.
  • Automated checks, not a guarantee. Every story passes through automated safety, age-appropriateness, reading-level, and coherence checks before delivery. These checks substantially reduce, but cannot entirely eliminate, the risk of inaccurate, inconsistent, or unsuitable output. AI systems can produce mistakes that look confident and plausible.
  • Not authoritative or educational advice. Learning content, including curriculum-aligned material and quiz answers, is generated automatically and may contain factual errors. It is intended to support, not replace, teaching, textbooks, or professional educational judgement. An adult should review content before it is used for instruction or assessment.
  • Adult supervision. The Services are designed to be used by children together with, or under the supervision of, a parent, guardian, or educator. You remain responsible for deciding what is suitable for your child or students.
  • We do not train on your content. We do not use your User Content, your child's profile information, uploaded photos, or Magic Buddy conversations to train AI models, and our AI providers are contractually bound not to do so on our behalf.

If a story or image is unsuitable, please report it using the in-app reporting control or contact us at safety@zunotales.com so we can review it and improve our filters.

4. User Content and Generated Content

You own what you create; we own what we create.
  • Your Content: You retain full ownership of any original text, prompts, or other content you submit to the Service ('User Content'). This includes stories written by children in 'Young Author Mode'.
  • Generated Content: All content generated by our engine, including story text, illustrations, and narration ('Generated Content'), is owned by Galactic Matrix - Portugal. We grant you a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and share the content generated for your stories for personal, family, and classroom purposes. Educators may reproduce and distribute Generated Content within their own institution for non-commercial teaching purposes.
  • License to Us: By submitting User Content, you grant Galactic Matrix - Portugal a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, modify, and create derivative works (such as translations or adaptations) of your User Content for the purpose of operating, securing, and improving our Services. This license does not permit us to use your User Content to train AI models, or to use your child's name, likeness, or stories in marketing without your separate, explicit consent.
  • Public Stories: If you choose to make a story public, you grant all users of the Service the right to view, share, and interact with your story. Public stories are excluded from search engine indexing by default. You can make a story private again at any time from your dashboard.

5. Child Safety and COPPA

Protecting children is our highest priority.

We are committed to complying with the Children's Online Privacy Protection Act (COPPA). We do not knowingly collect personal information directly from children under the age of 13. Child profile information is provided by an adult account holder who confirms they are the child's parent or legal guardian, or an educator authorised to act on behalf of their students. A parent, legal guardian, or authorized educator must create an account and any child/student profiles. Children cannot create their own accounts.

Parents have the right to review, edit, and delete their child's personal information at any time via their account dashboard. We will never share your child's personally identifiable information with third parties for marketing purposes, and we do not serve third-party advertising to children. If you believe we have inadvertently collected information from a child without parental consent, please contact us at privacy@zunotales.com so we can promptly remove it.

6. Magic Buddy and Talk Time

Magic Buddy is an optional guided AI conversation feature. It is off by default and must be enabled by the account owner. Conversations are subject to the same safety filtering as stories, are recorded in full and visible to the parent or educator in the app, and cannot be deleted or hidden by the child. Transcripts are automatically deleted after 12 months, and immediately if the child profile or account is deleted. Magic Buddy is a story companion — it is not a counsellor, tutor, or source of advice, and it is not a substitute for talking to a trusted adult.

7. Acceptable Use

Be kind and creative.

You agree not to use the Services to create, upload, or share any content that is unlawful, harmful, threatening, abusive, harassing, or defamatory. You also agree not to attempt to bypass our safety filters, to use the Services to generate content depicting real identifiable people without their consent, to scrape or bulk-extract content, or to resell access to the Services. We reserve the right to remove any content and suspend or terminate accounts that violate these rules.

8. Fees and Payment

8.1. General Terms

Some features of the Service require payment. Prices are shown and charged in your local currency where we support one — currently the euro, US dollar, British pound, Indian rupee and UAE dirham — and in euros elsewhere. The currency you will be charged in is shown at checkout before you pay. Fees are inclusive of applicable taxes unless stated otherwise. Galactic Matrix - Portugal reserves the right to change our prices; if we do, we will give you advance notice and any change will take effect at your next renewal. ZunoTales does not store your card details; card payments are processed by our payment providers.

Usage quotas for generated content are allocated on a calendar-month basis and reset on the first day of each month. Unused quotas do not roll over to the next month. Quotas are provided for ordinary personal or classroom use and may be subject to fair-use limits to protect service availability.

How you are billed depends on where you subscribed. Subscriptions purchased on our website are handled by our payment processor; subscriptions purchased in our iOS app are handled by Apple; and schools and institutions may instead be invoiced directly under a separate written agreement.

8.2. Subscriptions Purchased on Our Website

Website subscriptions renew automatically at the end of each billing period until cancelled. You may cancel at any time from your account settings. Cancellation stops the next renewal; your plan then remains active until the end of the period you have already paid for. We will email you a receipt for each payment.

8.3. App Store & Auto-Renewable Subscriptions

For users who purchase a subscription via the Apple App Store, the following terms apply, and Apple's own terms also govern the transaction:

  • Payment: Payment will be charged to your Apple ID account at the confirmation of purchase.
  • Auto-Renewal: The subscription automatically renews unless it is canceled at least 24 hours before the end of the current period.
  • Renewal Billing: Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
  • Managing Subscriptions: You can manage and cancel your subscriptions in your Apple ID account settings after purchase. We cannot cancel or refund an App Store purchase on your behalf.
  • Effect of Cancellation: Cancelling stops future renewals. Apple does not support cancelling part-way through a period that has already started, so you will retain access until the end of the current billing cycle. Refund requests for App Store purchases are handled by Apple. This does not affect your statutory rights described in section 9.

8.4. Schools and Institutions

Schools, districts, and other institutions may purchase access by invoice under a separate written agreement or purchase order. Where such an agreement conflicts with these Terms, that agreement prevails for that customer. Institutional accounts are also subject to our Data Processing Agreement.

9. Right of Withdrawal and Refunds

If you are a consumer in the EU or UK, you have 14 days to change your mind.

If you are a consumer resident in the European Union or the United Kingdom, you have the right to withdraw from a purchase within 14 days of the contract being concluded, without giving any reason.

Because the Services give you immediate access to digital content, you are asked to consent to immediate performance and to acknowledge that you thereby lose your right of withdrawal once performance has begun. Where you have given that consent and have begun using paid features, the 14-day right no longer applies to that purchase. Where you have not begun using paid features, you may withdraw within 14 days for a full refund.

To withdraw, or to request a refund, contact us at billing@zunotales.com from the email address on the account. We will confirm receipt and process any refund due using your original payment method within 14 days. Purchases made through the Apple App Store must be refunded by Apple.

Separately from your statutory rights, if the Services fail materially and we cannot resolve the problem for you, contact us — we will deal with it fairly.

10. Termination

You are free to leave at any time.

You may terminate your account at any time through your account settings. Galactic Matrix - Portugal may also suspend or terminate your access to the Services if you materially violate these Terms, or where required to protect the safety of children or the integrity of the Services. Where practical and lawful, we will give you notice and an opportunity to remedy the issue first. Upon termination, your right to use the Services will cease, and we will delete your data in accordance with our Privacy Policy. You can export or download your stories before deleting your account.

11. Disclaimers and Limitation of Liability

We do our best, but we provide the service 'as is'.

THE SERVICES ARE PROVIDED 'AS IS' WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that the Services will be uninterrupted or error-free, or that Generated Content will be accurate, complete, or suitable for any particular purpose.

TO THE FULLEST EXTENT PERMITTED BY LAW, GALACTIC MATRIX - PORTUGAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law. If you are a consumer, you have statutory rights that these Terms do not affect.

12. Governing Law and Disputes

These Terms shall be governed by the laws of Portugal, without regard to its conflict of law provisions. If you are a consumer resident in the European Union, you also benefit from the mandatory consumer protection provisions of the law of your country of residence, and you may bring proceedings in the courts of that country.

We would prefer to resolve any complaint directly, so please contact us first at contact@zunotales.com. Consumers in the European Union may also submit a dispute to the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

13. Changes to Terms

We may modify these Terms from time to time. If we make material changes, we will notify you in advance, for example by email or by a notice in the app, and we will update the 'Last Updated' date above. Material changes take effect no earlier than 30 days after notice, except where a change is required by law or is necessary to protect user safety. Your continued use of the Services after the changes take effect constitutes your acceptance of the new Terms. If you do not accept them, you may cancel your account.

14. Educator and School Terms

If you are an educator using the Services in a school environment, you represent and warrant that you have the authority to act on behalf of your school and students and have obtained all necessary consents (including parental consent as required by COPPA and FERPA) to create and manage student accounts and share student information with us.

Where your institution is the data controller for student personal data, we act as your data processor, and our Data Processing Agreement applies to that processing and forms part of these Terms. For US institutions, we act as a 'school official' with a legitimate educational interest under FERPA, and we use student data only to provide the Services to your institution.

The account owner can view teaching activity for their institution, manage educator invitations, and remove educators and student profiles. Removing a student profile deletes that student's stories and associated data.

15. Language of These Terms

These Terms may be made available in languages other than English for your convenience. If there is any conflict or inconsistency between the English version and a translation, the English version prevails.
